New U.S. Section 338 Tariffs: Is Your Business Affected?

The United States has announced an additional 50 per cent tariff on a broad range of Canadian products under Section 338 of the U.S. Tariff Act. The tariffs are scheduled to take effect on August 19, 2026, and will apply to selected goods even when they meet CUSMA requirements.

The measures cover products across several industries, including food and beverage, manufacturing, construction, clothing, furniture, electronics and sporting goods.

Businesses may be affected directly through exports to the United States or indirectly through suppliers, customers, contracts and changing costs.
